Refund & Cancellation Policy

I Smith & Co. is operated by India Smith (“I Smith & Co.,” “we,” “us,” or “our”).
I Smith & Co. provides customized creative and professional services. Because each project is different, the scope of work, timeline, payment schedule, cancellation terms, and refund terms may vary by project.
When a client has signed a proposal, service agreement, contract, or other project-specific agreement, the cancellation and refund terms in that agreement will apply to that project.
Cancellations and Refunds
If a project is cancelled, any refund will be determined based on the status of the project at the time of cancellation.
Factors that may be considered include:

Non-refundable expenses incurred for the project

Dates, project time, or business capacity specifically reserved for the client

Any cancellation or reservation terms included in the client's service agreement
If work has not begun and no project-specific costs or reserved capacity have been incurred, the client may be eligible for a full refund.
If work has begun, the portion of the payment associated with work already performed, completed deliverables, or non-refundable project expenses will not be refunded. Any remaining amount eligible for refund will be determined based on the work completed and the terms of the client's service agreement.
Some projects require I Smith & Co. to reserve specific dates or a significant amount of project capacity. When applicable, the client's service agreement may identify a reservation fee, cancellation fee, or other non-refundable portion of the payment. Any such terms will be communicated before the client agrees to the project.
Scheduled and On-Location Services
Projects involving scheduled events, travel, content capture, or other time-specific services may have additional cancellation or rescheduling requirements. These requirements will be included in the applicable proposal or service agreement.
Non-refundable travel expenses, reservations, rentals, or other project expenses already incurred may remain the client's responsibility as outlined in the applicable agreement.
If I Smith & Co. Cannot Provide the Service
If I Smith & Co. is unable to provide an agreed service, the matter will be addressed based on the work already completed, any applicable service agreement, and the circumstances of the project. When appropriate, this may include a refund of amounts paid for services that were not provided.

For projects involving on-location content capture or other in-person creative services, I Smith & Co. travels to the location agreed upon with the client. The location, date, scope, travel arrangements, and applicable expenses will be established for that specific project.
Project Timelines
Because I Smith & Co. provides customized services, there is no single fulfillment timeline that applies to every project.
The expected timeline, milestones, deliverables, and target completion date will be communicated to the client based on the scope of the project. Timelines may be included in a proposal, service agreement, project plan, or other written communication.
Client delays, including delays in providing required content, feedback, approvals, access, or other materials, may affect the project timeline.
If a significant change to the expected completion date becomes necessary, I Smith & Co. will communicate the change to the client.
Physical Products and Shipping
I Smith & Co. does not currently sell or ship physical products through this website.
Current services and deliverables are provided digitally or through agreed on-location services. Therefore, physical shipping and delivery times do not currently apply.
If I Smith & Co. begins offering physical products in the future, this policy will be updated before those products are offered for sale.

Before work begins, the scope of the project and applicable terms may be provided through a proposal, service agreement, invoice, or other written project documentation.

Clients will receive applicable pricing and payment information before agreeing to paid services.

Delays in providing required materials, feedback, approvals, or access may affect the project timeline.
6. Third-Party Platforms and Services
Some projects may involve third-party platforms, software, applications, hosting providers, payment processors, domain providers, plugins, or other outside services.
These third parties operate under their own terms, policies, pricing, and technical requirements. I Smith & Co. does not control changes, outages, pricing changes, account decisions, or other actions taken by third-party providers.
Clients are responsible for any third-party accounts, subscriptions, licenses, or fees assigned to them unless otherwise stated in the applicable service agreement.
7. Intellectual Property
Ownership and permitted use of custom work created for a client will be governed by the applicable proposal or service agreement.
I Smith & Co. does not claim ownership of original materials provided by a client. Clients remain responsible for confirming that they have permission to use materials they provide for their project.
Nothing on this website grants permission to copy, reproduce, distribute, sell, or otherwise use I Smith & Co. website content, branding, original materials, or other protected content without permission.
8. Cancellations and Refunds
Cancellations, rescheduling, and refunds are governed by the I Smith & Co. Refund & Cancellation Policy and, when applicable, the client's individual proposal or service agreement.
